SoCal TMS Centers (“us”, “we”, “our”, “SoCal TMS”) together operate the www.socaltms.com website (the “Service”).

Service: Service is the www.socaltms.com website operated by Southern California TMS Center.

Medical Services: Services provided SoCal TMS centers, particularly TMS and Spravato treatments for severe depression.

Personal Data: Personal Data means any information or data about a living individual who can be identified from said data (or from those and other pieces of information either in SoCalTMS’s possession or likely to come into our possession).

Third-Party Providers: Third-Party vendors, service providers, contractors, or agents (“third parties”) who perform services for us or on our behalf and require access to such information to do that work.

Usage Data: Usage Data is data or information gathered automatically either generated by the use of the Service or from the Service infrastructure itself (take for example, the duration of a page visit).

  • SoCal TMS’s legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.

SoCal TMS Center may process your Personal Data because:

  • We need to perform a contract with you
  • You have given us permission to do so
  • The processing is in our legitimate interests, and it’s not overridden by your rights​
  • For payment processing purposes for medical services rendered.
  • To comply with the law

Retention of Data:

SoCal TMS will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. SoCal will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

Disclosure of Data:

Business Transaction

If SoCal is involved in a merger, acquisition or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.

Disclosure for Law Enforcement

Under certain circumstances, SoCal may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Process to Make a CCPA Request

To make an access or deletion request, please contact us at legal@socaltms.com. Before completing your request, we may need to verify your identity or the identity of your authorized representative. We will send you a link to verify your email address and may request additional documentation or information solely for the purpose of verifying your identity. You have the right not to receive discriminatory treatment for the exercise of your privacy rights conferred by the CCPA.

Removal of Content

If you are a California resident under the age of 18, and a registered user of any site where this policy is posted, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you have publicly posted.

To make such a request, please send an email with a detailed description of the specific content or information to legal@socaltms.com. We may employ third party companies and individuals to facilitate our Service (“Service Providers”), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used. Third-Party Providers:

We may share your data with third party providers. SoCalTMS Center has contracts in place with our third parties, which are designed to help protect your private data. This means that aforementioned third-party providers cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organization apart from us. They also commit to protect the data they hold on to our behalf and to retain it for the period we instruct.
